Online Shopping Terms and Conditions

GENERAL CONDITIONS

  1. By purchasing or using this SPAR Gift Card, the purchaser and/or cardholder agree to be bound by these terms and conditions.
  2. The purchaser and/or cardholder may be required to provide identification (ID) and FICA documentation to purchase or use the Gift Card in accordance with applicable legislation.
  3. The SPAR Gift Card is redeemable in-store only and cannot be used for online purchases.
  4. The SPAR Gift Card has a validity period. Once loaded, the card is accessible for up to 3 years from the date of the last transaction. After 3 years of inactivity, access to the remaining balance may be lost.
  5. The SPAR Gift Card may be loaded with a minimum value of R100 and a maximum value of R5,000.
  6. No interest will be payable on the balance of the Gift Card.
  7. The SPAR Gift Card is redeemable at SUPERSPAR, SPAR, KWIKSPAR, SPAR Express, SaveMor, TOPS at SPAR, SaveMor Liquors and Build IT stores.
  8. A signature may be required when using the Gift Card. The cardholder must sign the transaction slip where required.
  9. The cardholder will receive a transaction slip reflecting the balance remaining after each use.
  10. The SPAR Gift Card is non-transferable and may only be used by the cardholder.
  11. The total value of the transaction will be deducted from the Gift Card balance at the time of purchase.
  12. If the purchase amount exceeds the Gift Card balance, the shortfall may be paid by:
    1. Cash or other accepted payment method at the point of sale; or
    2. An additional SPAR Gift Card.
  13. The Gift Card may only be used for lawful purposes. Any fraudulent use of the Gift Card will result in cancellation of the card without refund.
  14. No cash refunds will be issued for any unused Gift Card balance. The balance may only be used to purchase goods at participating SPAR stores.
  15. SMS notification rates may apply for balance enquiries and transaction notifications sent to your registered mobile number.
  16. The balance on your SPAR Gift Card can be checked at whatsonmycard.com or at any participating SPAR store.
  17. In the event that your Gift Card is lost, stolen, or damaged:
    1. Report the loss, theft or damage to SPAR customer services immediately;
    2. Provide proof of purchase of the Gift Card;
    3. A replacement card may be issued for the remaining balance, subject to verification and at SPAR’s discretion.
  18. SPAR shall not be liable for any loss or damage arising from the loss, theft, or unauthorised use of the Gift Card prior to reporting. The cardholder assumes all risk for the Gift Card once it has been issued.
  19. The SPAR Gift Card is issued subject to Standard Bank’s terms and conditions, available at standardbank.co.za/termsandconditions.
  20. In the event of any conflict between these SPAR Gift Card terms and conditions and Standard Bank’s terms and conditions, Standard Bank’s terms and conditions shall prevail.
  21. Exchanges and returns on goods purchased with the SPAR Gift Card are subject to the store’s returns policy. The original purchase receipt and the Gift Card must be presented when returning goods.
  22. No warranties are given regarding the fitness for purpose of any goods purchased with the Gift Card, other than as provided for under the Consumer Protection Act.
  23. No variation of these terms and conditions shall be of any force or effect unless agreed to in writing by SPAR.
  24. These terms and conditions are governed by the laws of the Republic of South Africa and any disputes arising therefrom shall be subject to the jurisdiction of the South African courts.
  25. The SPAR Gift Card may not be resold or used for commercial purposes.
  26. SPAR reserves the right to decline a purchase authorisation if the Gift Card is suspected to be fraudulent or if the cardholder has violated these terms and conditions.
  27. This Gift Card constitutes a stipulatio alteri (a contract for the benefit of a third party) in favour of the cardholder where the purchaser and cardholder are different persons.
